CLIENT AGREEMENT

Please take the time to read this Client Agreement so you can get the most out of our arrangement; that way we walk and talk in alignment. The items listed below form our Coach - Client Agreement. This document is intended to have legal significance. As such, you are free to consult with your legal advisor. 

Allison Todd may refer to herself as an Integrative Practitioner simply to summarize her professional trainings which include Registered Nurse (RN), Functional Medicine Certified Health Coach, Functional Blood Chemistry Specialist and more (listed on the website) with an overall integrative, holistic approach that draws from many disciplines, methods, and philosophies. 

Integrative Practitioner, Practitioner or Coach may be used in place of RN, Functional Medicine Certified Health Coach, Functional Blood Chemistry Specialist etc. instead of referring to the specific discipline in which applies to the topic as all the professional trainings have overlapping concepts.

ART Health Co. defines its Integrative approach as client-focused, whole-person including all aspects of lifestyle – physical, mental, emotional, and even spiritual. Using integrative approaches that are both evidence based, and experience based. Integrative approaches combine a variety of disciplines, including but not limited to conventional, alternative, complimentary, functional and holistic.

"ART Health Co services" include Coaching, Courses/Programs/Challenges, Functional Blood Chemistry and any other education, services and content created by ART Health Co.

Nature of Relationship

Entering into this coach – client relationship as a client, it is in no way to be construed as medical advice, counseling/therapy or other. In the event you feel the need for professional services, it is your responsibility to seek the appropriate licensed healthcare professional to provide you with those services.

Results are not guaranteed. You enter into ART Health Co. Services with the understanding you are responsible for creating your own results. As a Coach, I guide you in your effort to achieve the health-life-related goals and results you seek.

I want you to be happy with our relationship. If I ever say or do something that upsets you or doesn't feel right, please bring it to my attention. As your coach, I am 100% committed to you being empowered and successful in creating the health and life you seek.

It is necessary for you, the client, to be an active participant for coaching to be successful. You have hired a coach to help you do things differently. If you choose not to use the coaching, and keep doing what you have always done, you will get the same results you have always received. If nothing changes, nothing changes.

Client Responsibility

Coaching Sessions

All sessions are 45mins in duration. 

Health on Purpose Coaching Program is a minimum of 12 sessions. I ask that you submit the weekly Check-In questions 24 hours in advance before our session and come prepared with anything extra that you feel would benefit the session. By coming to each session prepared, you can benefit better from our coaching session together. 

Functional Blood Chemistry support can be via weekly message support. A call can be scheduled if needed. If many calls are scheduled, or they are long in time, additional charges may apply.

Payment

All “ART Health Co. services” are paid for using the service Stripe, in full or payments offered.

Communication

I am available for messages or email during normal business hours Monday-Friday. I will do my best to respond within 24-48 hours. Please be aware of holidays taken in relation to response times.

Rescheduling Check-in Calls

Please make sure the weekly Check-Ins are a priority, after all, these sessions are about you! If you need to reschedule, please feel free to schedule/reschedule a new call time or reach out, and then I ask that you please let me know so I can clear the open spot for someone else. If you need to reschedule, I ask you give me 24 hours' notice of the change. If you are on vacation or unable to meet one week, no worries, you will pick up when you are able. If you are in a group, we will meet on our pre-determined day of the week and time, please discuss in the beginning if we all need to skip a week to plan accordingly.

Holidays

My current/most common vacation time of the year are Spring Break, 4th of July week, week of/between Christmas and New Year's. I also observe the other general holidays during the year.  I will have sessions blocked off during these weeks/days on the schedule. Should one of these days or weeks land during our time together, you will not be shorted a session, we will extend another week.

Confidentiality

The existence of this coaching relationship, as well as any information the Coach/Practitioner receives from the Client, are to be fully and completely confidential under the terms of this Agreement. The Coach/Practitioner will not disclose any information about the Client without the Client's consent unless subject to a legal requirement, such as a court order, subpoena, or law enforcement inquiry. It will be the Client's responsibility to address any confidentiality issues with the Coach/Practitioner.

Confidential information under this Agreement shall specifically not include the following categories: (1) information that is generally known to the public or known to Client's specific industry, (2) information freely given by Client to any third-party; (3) information received by Coach from any source that is not Client; (4) information in Coach's possession prior to this contractual Agreement; (5) information developed independently by the Coach; (6) information which is received by the Coach from the Client but that may imminently harm the Client or another individual; or (7) information about any illegal activity.

Termination of Agreement & Refund Policy:

Due to the digital nature of “ART Health Co services,” no refunds will be given. ART Health Co. reserves the right to terminate our agreement and cancel the rest of the sessions without refund or explanation should a client manifest hostile, aggressive, inappropriate, or violent behavior. If, however, ART Health Co. should choose to refund a client, the refund (based solely on ART Health Co.’s discretion) will be calculated on the remaining sessions (minus the cost of the course if applicable). ART Health Co. also reserves the right to remove the client from any platform used if any copyright, misconduct etc. occurs against ART Health Co or coaching via in person, online or elsewhere.

RELEASE OF LIABILITY

This agreement releases ART Health Co. and Allison Todd from any and all liability relating to legal, health, medical, financial, business, spiritual or other matters. By agreeing to this the client releases ART Health Co and Allison Todd entirely free from any liability and admit the client is participating voluntarily and that all the risks have been made clear. Additionally, the client admits to not having any conditions that could increase likelihood of death or injury physically, legally, medically, financial, business, spiritually or other matters, and/or have been cleared by professionals in these areas. By agreeing to this, the client forfeits all right to bring a suit of any kind against Allison Todd or ART Health Co. for any reason.

I hereby acknowledge and agree:

 

1. The purpose of ART Health Co. services is to improve the overall health, vitality and well-being of the body through lifestyle and nutritional education and the use of natural foods and possibly supplements. Allison Todd, does not diagnose or treat diseases, disorders, conditions nor does she prescribe.

2. Allison Todd is not a physician, psychologist or other, and the scope of her services do not include treatment or diagnosis of specific illnesses or disorders. If I, the client, suspect I may have an ailment or illness that may require medical attention, then it is my responsibility to consult with the appropriate licensed healthcare professional immediately. Only specific licensed healthcare professionals can prescribe medications.
 
 3. 
Any mention of medications is only for the purpose of providing a complete history of medications that the client is taking and not for Allison Todd to judge the appropriateness of the medication. Any change in prescription or dosage is a decision the client makes with his or her physician.
 
 4. Rather than dealing with treatment of disease, Allison Todd focuses on overall wellness and possible prevention of illness through the use of habit change in nutrition and lifestyle to achieve optimal health. As an Integrative Practitioner, Allison Todd primarily educates and motivates clients to assume more personal responsibility for their health by adopting a healthy mindset, lifestyle, and nutrition habits.
 
 5. While people generally experience greater health and wellness as a result of embracing a healthier mindset, lifestyle, and nutritional habits, Allison Todd and ART Health Co. do not promise or guarantee results or protection from future illness.

6. In addition, I have/will give Allison Todd a complete and accurate health history and any medications that I am taking.

7. As part of “ART Health Co. services,” I may be asked to provide information concerning my physical habits, medical history, moods, energy levels, likes and dislikes, lifestyle and diet. This information is collected to enable the Practitioner/Coach to: (i) assess my knowledge of nutrition, (ii) education me about the benefits of sound nutritional practices and (iii) recommend dietary changes to improve my general health, vitality and overall well-being. The Practitioner/Cocah, Allison Todd will hold this information in confidence and will not release or disclose this information to any other person, without my prior consent, except as required by applicable law.

8. If the Practitioner, Allison Todd, suspects the existence of disease, disorder or condition, I will be informed of this suspicion. However, I acknowledge this is not a diagnosis or conclusion about the state of my health and that I am directed to promptly consult the appropriate licensed healthcare professional about any suspected problems.

9. Should I request the Practitioner/Coach, Allison Todd, to recommend dietary changes and/or nutritional supplements to enhance my body’s natural ability to resist and/or overcome a known disease, disorder or condition, it is my responsibility to disclose the nature of the disease, disorder or condition and all other relevant details to Allison Todd. If I have not previously consulted a licensed Physician or Naturopath about this disease, disorder or condition, I acknowledge that I am directed to promptly do so. I am not to alter or discontinue treatments prescribed by a licensed healthcare professional without consulting the individual who prescribed the treatment and will first consult with the licensed healthcare professional about any recommendations made by Allison Todd.

10. In providing health coaching services to me, the Practitioner/Coach, Allison Todd, is relying upon the truth, accuracy, and completeness of all information I have provided to her. Any recommendations I follow for changes in nutrition, including the use of nutritional supplements, are entirely my responsibility.

11. Allison Todd is in no way liable for my health or safety.

12. In consideration of my participation in “ART Health Co. services,” I hereby accept all risk to my health, including injury or death that may result from such participation and I hereby release the ART Health Co and Allison Todd, on my behalf and on behalf of my personal representatives, estate, heirs, next of kin, and assigns from any and all costs, claims, causes of action and damages arising from any and all illness or injury to my person, including my death, that may result from or occur as a result of my participation in the Health Coaching services, whether caused by negligence or otherwise.

13. You may request a refund within the first two weeks of the program, minus $50 for administrative fees. See Termination and Refund for additional details.

14. I understand that any recommendations I undertake at ART Health Co. are undertaken of my own free will. I accept that the ultimate responsibility for my health as my own, and that ART Health Co. and Allison Todd is here to support me in this. I understand that my The Practitioner, Allison Todd reserves the right to determine which cases or specific topics fall outside her scope of practice, in which event an appropriate referral will be recommended. I hereby agree to assume full responsibility for any manner of loss, injury, claim or damage whatsoever, known or unknown, incurred as a result of same and I, my heirs, executors, administrators or assigns for any loss, injury, claim or damage sustained as a result of my attendance and/or participation. I have read the above client coaching agreement, release and waiver of liability, disclaimer and fully understand its contents and voluntarily agree to the terms and conditions stated.

15. By signing this document, I acknowledge that I understand that Allison Todd is an Integrative Practitioner (RN, Health Coach, Blood Chemistry Specialist) and not a physician or other, and that I should seek the appropriate licensed healthcare professional if I think I have a medical condition or other. Allison Todd and ART Health Co. will not be held liable for failure to diagnose, prescribe, or treat an illness, nor will she be liable for failure to prevent future illness.

DISCLAIMER

Allison Todd is not a physician or psychologist or other, and the scope of her services does not include prescription, treatment or diagnosis of illness, disease or disorders. If I, a client, suspect I may have an ailment or illness that may require medical attention, then it is my responsibility to consult with the appropriate licensed healthcare professional immediately.

Allison Todd focuses on health and prevention of diseases through the use of habit change, nutrition and lifestyle to achieve optimal health. As an Integrative Practitioner, Allison Todd primarily and generally educates and motivates clients to assume more personal responsibility for their health and life by adopting a healthy mindset, lifestyle, and nutrition via habit changes.

While people generally experience greater health and wellness as a result of embracing a healthier mindset, lifestyle, and nutrition, Allison Todd does not promise or guarantee protection from disease now or in the future.

ART Health Co. materials include information on the website, social media sites, podcasts (host, co-host or guest), coaching, courses, programs, challenges, blood chemistry services, subscriptions etc. 

By continuing with any ART Health Co. materials or services, I, the client, acknowledge and understand that Allison Todd is not a physician, and that I should see a doctor if I think I have a medical condition. Allison Todd will not be held liable for failure to diagnose or treat an illness, nor will she be liable for failure to prevent future illness, disease or disorders.
